Online Auction Terms and Conditions

Please take a moment to read the terms and conditions of registration with Number One Auctions.

1. By registering to bid at Number One Auctions you agree to close the transaction pursuant to the terms and conditions of sale.

2. All items are sold as is, where is and with all faults. Number One Auctions and the consigning sellers do not offer any kind of warranty expressed or implied as to any items condition, quality or value. Inspection of items prior to the day of the auction will be posted on the auction information page with dates, time and location of inspection. No refunds will be awarded for errors in the items description, photo, defect, or anything wrong with the asset item. It is the bidder's sole responsibility to inspect the item before bidding.

3. To bid on an item, you must register. Once registered you will be able to bid on every auction listed on Number One Bidders are required to submit a valid full name, address, email address and phone number. You need to enter your credit card information into our secure server. We accept Visa, MasterCard and Discover. If you do not feel comfortable entering this information through our secure website we do offer registration via phone. Please visit our contact page and a representative will be in touch with you shortly to complete the registration process. Number One Auctions reserves the right to reject registration to any person or entity. Bidding on an item is a contract that is enforceable in a court of law. We will pursue all legal remedies required to enforce this contract. The terms of usage prevent retraction of a bid once it has been made. If you are unsure about an item, DO NOT BID! No bids will be retracted.

4. Shortly after the conclusion of each auction, you will be emailed an invoice which you will need to bring for removal of your purchases during the designated hours. It is the responsibility of the buyer to check your email for the invoice. If you have not received an invoice within 2 hours after an auction ends, feel free to call or email our office. All invoices must be paid in full by 4:00pm EST the day after the conclusion of the auction, cash, MC, Visa, Discover, no checks. If the invoice is not paid by 4:00pm it will be charged to the credit card on file. We offer a 3% discount if paying cash by 4:00pm on the scheduled removal date. No items may be removed from premises before any invoice has been settled. Number One Auctions reserves the right to ban all nonpaying bidders from future auctions until unpaid invoices are settled in full.

5. A buyer's premium is in effect. Number One Auctions will charge an additional 15% buyer's premium to all invoices. For example if you bid $100.00 on an item and win, your invoice will be charged $100.00 plus a 15% buyer's premium of $15.00 for a total of $115.00 plus any sales tax that may apply.

6. Florida sales tax (Orange County, 6.5%) or sales tax for the county and state in which the equipment is located will be charged on all items. If you will be reselling the item, you must email your Florida resale certificate to prior to the auction end date. If the certificate is not received and confirmed, you will be charged sales tax and will have to apply for the refund to the state of Florida (or the state where the equipment is located). The state of Florida does not accept out of state resale certificates.

7. Removal of items will take place during the designated times listed in the terms for each individual auction. If a bidder fails to remove an item or arrange for shipping within the time frame allowed, Number One Auctions and its consigner reserve the right to deem the item abandoned by the bidder and the bidder will lose any rights to that item and payment will still be due. The auctioneer's and seller's liability is limited to the purchase price plus applicable buyer's premium and sales tax for an item.

8. By registering with Number One Auctions you agree to hold harmless both Number One Auctions, its owner and any consigner against any claim or liability resulting from assets sold, including but not limited to: proximate or consequential damages, failure to comply with local, state or federal laws, and cost or legal expenses arising there from.

9. No children or pets are allowed at the auction site during inspection or removal.

10. All bidders enter auction site at their own risk. Any accident or harm caused is not the responsibility of the auctioneer or the consigner.

11. If any bidder fails to complete their transaction, Number One Auctions and its consigners reserve the right to dispose of the item at the bidder's expense. The auctioneer and its consigner may offer the item to another bidder. If a bidder fails to complete a transaction they will be barred from future Number One Auctions until all transactions are completed.

12. Number One Auctions reserves the right to add or delete items from any auction.

13. Number One Auctions acts as an agent to the consigner and is not responsible for actions or principles.
